These Terms of Use (“Terms”) govern your access to and use of educationcovenantproject.com (the “Site”), operated by the Education Covenant Project (“ECP,” “we,” “our,” or “us”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. About ECP and the Site
ECP partners with Jewish day schools and their communities to help them prepare for and take advantage of a federal scholarship tax credit. ECP provides strategic planning, campaign support, and pledge coordination. ECP is not a Scholarship Granting Organization (SGO), a law firm, or a tax advisory service, and does not itself accept or distribute tax-credit-eligible scholarship donations.
2. Pledges Are Non-Binding
- A “pledge” submitted through the Site is a non-binding statement of intent only. It is not a contract, not a legally enforceable commitment, and not a charitable donation.
- Submitting a pledge does not obligate you to make any future donation, and does not obligate ECP, any school, or any SGO to provide you with any scholarship, tax credit, or other benefit.
- The federal scholarship tax credit referenced on the Site is not active until January 2027. No tax-credit-eligible donations can be made, and no scholarships can be distributed, until that date and until applicable state and federal requirements are satisfied.
- Pledges are collected solely to help participating schools estimate anticipated community participation and plan responsibly. Actual donations, if and when made, will be governed by separate terms provided by the applicable SGO or donation platform at that time.
- You may modify or withdraw a pledge at any time by contacting us; doing so carries no penalty or obligation.
3. No Legal, Tax, or Financial Advice
Information on the Site about the federal scholarship tax credit, eligibility, or the pledge and donation process is provided for general informational purposes only. It is not legal, tax, or financial advice, and should not be relied upon as such. You should consult your own attorney, accountant, or financial advisor regarding your specific situation before making any tax-related decision.
4. Future Donations to ECP
ECP intends to accept direct donations to support its own operations, separate from school-specific pledges or SGO donations.
5. Eligibility and Acceptable Use
You agree to use the Site only for lawful purposes. You agree not to:
- Submit false or misleading information in any form on the Site
- Attempt to gain unauthorized access to any part of the Site or its underlying systems
- Use the Site to transmit malicious code or interfere with its operation
- Use automated means (e.g., bots or scrapers) to access or collect data from the Site without our permission
- Impersonate any person or entity, or misrepresent your affiliation with a school or organization
6. Intellectual Property
All content on the Site — including text, graphics, logos, and design elements — is owned by ECP or its licensors and is protected by copyright and other intellectual property laws. You may view and share Site content for personal, non-commercial purposes, but may not reproduce, modify, or distribute it for commercial purposes without our prior written permission.
7. Third-Party Links
The Site may contain links to third-party websites, including SGOs, partner schools, and outside informational resources. These links are provided for convenience only. ECP does not control and is not responsible for the content, accuracy, or privacy practices of any third-party site.
8. Participating Schools and Third-Party Content
References to “participating schools,” logos, testimonials, or quotes on the Site reflect information provided by or about those schools and individuals at the time of publication. ECP will remove or correct such content upon reasonable request.
9. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. ECP DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION ON THE SITE (INCLUDING REGARDING THE FEDERAL TAX CREDIT) IS CURRENT, COMPLETE, OR ACCURATE.

You agree to indemnify and hold harmless ECP and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site or your violation of these Terms.
